Important Notice regarding Payments: Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Use of your personal data by Lemon Squeezy is subject to the Lemon Squeezy Privacy Policy.

These Terms of Service (the "Terms") constitute a legal agreement between Ishfaq ul Haque (operating as "Email 360 Pro", "We", "Us", or "Our"), located at 15 New Eskaton Road, Ramna, Dhaka-1000, Bangladesh, and you ("User", "Client", or "You").

By accessing or using the Email 360 Pro website and services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Services Provided

Email 360 Pro provides a web-based email automation platform that allows users to send bulk, personalized emails via their own SMTP servers or connected Google/Outlook accounts ("the Service").

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service strictly in accordance with these Terms.

2. Account Registration and Security

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at security@email360.pro if you suspect any unauthorized use of your account.

3. Acceptable Use Policy (Anti-Spam)

We have a zero-tolerance policy for spam. By using Email 360 Pro, you agree to comply with the CAN-SPAM Act, GDPR, and other applicable anti-spam laws.

You strictly agree NOT to:

  • Send unsolicited emails to people who have not given you permission to contact them (Cold emailing must comply with local laws).
  • Use purchased, rented, or scraped email lists.
  • Send content that is illegal, phishing, fraudulent, or promotes prohibited goods (e.g., weapons, drugs).

We reserve the right to immediately suspend or terminate your account without refund if we detect suspicious sending activity or high bounce/complaint rates.

4. Payments, Refunds, and Taxes

4.1 Merchant of Record

Payments for Email 360 Pro subscriptions are processed by Lemon Squeezy, our authorized reseller and Merchant of Record. When you purchase a subscription, you are entering into a transaction with Lemon Squeezy.

4.2 Subscriptions

Paid subscriptions are billed in advance on a monthly or yearly basis. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period.

4.3 Refunds

We offer a 7-Day Money-Back Guarantee for new subscriptions. If you are not satisfied with the Service, you may request a refund within 7 days of your initial purchase by contacting billing@email360.pro. Please review our full Refund Policy.

4.4 Taxes

Lemon Squeezy handles the collection and remittance of applicable sales tax, VAT, or GST based on your location.

5. Intellectual Property

The Service, including its "look and feel" (e.g., text, graphics, images, logos) and underlying code, is proprietary content owned by Ishfaq ul Haque and is protected by copyright and intellectual property laws. You agree not to copy, duplicate, sell, or resell any part of the Service without express written permission.

6. Third-Party Services (Google & SMTP)

Our Service integrates with third-party services like Google API (Sheets) and SMTP providers. Your use of these integrations is subject to their respective terms:

  • Use of Google user data is limited to the functionality required to import your contact lists or data from Google Sheets and is governed by the Google API Services User Data Policy.
  • We are not responsible for the uptime, availability, or policies of your chosen SMTP provider (e.g., SendGrid, Mailgun) or email service (e.g., Gmail, Outlook).

7. Limitation of Liability

To the maximum extent permitted by law, Email 360 Pro and Ishfaq ul Haque shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from:

  • Your access to or use of (or inability to access or use) the Service;
  • Any conduct or content of any third party on the Service;
  • Any unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. You agree to submit to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh to resolve any legal matter arising from these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice within the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
